The laws about Illinois parenting time and visitation are found in Part VI of the Illinois Marriage and Dissolution of Marriage Act. If you have sole custody, the non-custodial parent has visitation with the child and you need to make a visitation schedule that shows when each parent has parenting time.

Your parenting time or visitation schedule should include:

A residential schedule that shows weekday and weekend parenting time

A holiday schedule that shows holiday and special occasion parenting time

A summer break schedule that shows summer break parenting time

Each parent’s vacation time with the child

You can put all of your schedules in a custody calendar so it’s easy to see what’s going on. You can include your calendar and your schedule in legal terms in your parenting agreement.

Provisions are rules in the parenting agreement that parents agree to follow as they share the responsibility to raise their child.

A common provision is the right of first refusal. The right of first refusal is when a parent must first offer the other parent the opportunity to take the child if the parent is leaving the child with a child-care provider. The court can also order this provision to be in the agreement. You can include other provisions about time-sharing in your Joint Parenting Agreement to help the parenting time and visitation run more smoothly.

If you and the other parent work together to make your parenting time schedule, you can have any time sharing arrangements you want. If you and the other parent can’t agree on a visitation schedule, the court will make one for you. There is no standard schedule for the state of Illinois, but many courts order a schedule that looks something like this.

The child visits the non-custodial parent:

Every other weekend

One evening or overnight each week
